The following are terms and conditions for the sale of goods that will govern any contract for sale that we enter into with you. Please read these terms and conditions carefully.

Digital Workshop's Terms and Conditions

These Terms and Conditions tell you the rights and obligations you have. Please read these carefully. You may have other rights granted by law and these Terms and Conditions do not affect these.

This does not affect your statutory rights as a consumer.

Office hours are 9am to 5:30pm, Monday to Friday. Please note we are based in the UK and you should allow for any time difference between GMT/BST and your timezone.

Purchasing from us

By submitting your order you are offering to buy a licence to use our software as per the end user licence provided with the software and allowing us to use your personal details for the purposes of supplying goods (including passing your details onto couriers where boxed copies or media packs are required). We will also use your information to advise you of improvements to the software and updates which are available. We will not use your details for other purposes without asking your consent and you may ask that your details are removed from our system by writing to the address above. We do not store financial information.

We are not obliged to supply the software/goods to you until we have confirmed acceptance of your order and this is when the contract is made. You do not own the licence/goods until we receive payment in full but where credit terms have been agreed a temporary licence can be assumed. Should payment subsequently be rescinded because of credit card fraud your licence is immediately invalid.

If you discover you have made a mistake with your order please contact Sales immediately. Please do this before we confirm your order.

When you order software from us you are bound by the terms of the software licence supplied with the software. Should you disagree with these terms please contact sales within 7 days to arrange a refund as below.

 

Cancellation

You have the right to cancel your order or return goods within 7 days of the date of your order.

Should you require a longer period to evaluate our software a free, fully-functional evaluation version is available which allows up to 30 days of use.

Price Changes

Prices are checked regularly, however if we find the price has changed when we receive your order we will contact you and ask if you wish to proceed unless the price is lower in which case we will simply proceed at the lower price or refund the difference in the case of online orders.


All prices and offers are subject to change and availability. Where appropriate VAT will be charged on all prices (including carriage) at a rate of 20%. Allow ten working days for cheque clearance. For out of stock items, delivery dates given are only estimates.

Software Downloads

In most cases your software is delivered electronically via a time-limited download link, or you will be provided with an unlock key to unlock an evaluation copy you have already downloaded. We recommend that you create a backup of the setup program on CD Rom to allow you to reinstall once the download link has expired.

The ESD download link is available for 7 days during which time you can download a limited number of times. Should you require this link to be renewed for any reason please contact sales but note that we reserve the right to make an additional charge.

Please note that we take appropriate measures to combat software piracy and your software is provided with a numerical licence key. We recommend that you keep a record of this key in case you need to reinstall the software and that you keep this key private and secure. We reserve the right to immediately rescind your licence and take appropriate legal action if illegal copies of our sofware containing your key are discovered, for example on software crack sites or file-streaming sites.

Delivery

We no longer supply physical boxed copies of our products.

Where a physical CD has been ordered by special arrangement or we are supplying a non-software item, we aim to deliver goods to you within the time indicated by us but we cannot give an exact delivery date. If we have not delivered the goods within 30 days of expected delivery then you may cancel the contract. We will refund any money paid by you.

In the unlikely event of experiencing any issues, contact sales@digitalworkshop.com. We will acknowledge all questions or queries within a maximum period of 48 hours (excluding weekends).

Damaged or defective goods

All physical copies are warranted as free from defects in materials and workmanship for a period of 12 months (or longer if required by law) from the date of delivery.

You should inspect the goods when you receive them for defects or damage. If you find a defect or damage you must tell us as soon as possible and, in any case within 10 days and we will arrange for their return to us at no cost to you. If the goods are found to be damaged prior to delivery to you, or defective, we will at our option repair or replace the goods or refund the price paid by you.

Software Warranty

Our software has been tested to ensure that it is fit for purpose within the following limitations - the software provides a complex combination of features for a wide range of output types - not all combinations of features may be supported in all output formats. The software relies on thrid party software most notably Windows and Adobe Flash, and internet-based material is dependent on functionality in the users internet browser. The perfomance of these programs is outside the control of Digital Workshop and we cannot provide any warranty in that respect.

We provide a fully-functioning evaluation version of our software which allows you to test the software to ensure it meets your requirements and will create the material you require.

Returns & Refunds

If you need to return goods for any of the reasons detailed above please contact sales@digitalworkshop.com within the timescales detailed above (7 days in most cases).

In order for us to make a refund for software you will be required to confirm in writing that you have deleted all copies of the software and any publications created with it.

Returns and refunds will NOT be accepted in regard to software upgrades.
